To receive a report from Chris Doyle, Licensing Enforcement Officer (Taxis) on the above application. (Copy attached)

Minutes:

12/22 – LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976

TOWN POLICE CLAUSES ACT 1847 – PROPOSED REVOCATION/

SUSPENSION OF A HACKNEY CARRIAGE AND PRIVATE HIRE DUAL

DRIVERS LICENCE: The Taxi Licensing Enforcement Officer (TLEO) submitted a written report to determine whether a Hackney Carriage and Private Hire Dual Drivers Licence should be suspended or revoked. It was before the Panel to consider the TLEO’s written report, the applicant’s DBS Certificate and associated application documentation and numerous supportive character references as distributed by the TLEO and the applicant’s representation. The Panel were asked to refer to the Harrogate Taxi and Private Hire Licensing Policy 2022 and the relevant legislation as outlined at paragraph 5 of the exempt report.

The TLEO presented the report and asked the Panel to consider whether the applicant was a ‘fit and proper’ person for the purpose of retaining their Hackney Carriage and Private Hire Dual Drivers Licence. The Panel applied the test contained within the Department for Transport Statutory Taxi and Private Hire Vehicle Standards 2020 of whether they would allow a person for whom they cared to travel alone with the proposed licence holder at any time of day or night. The applicant and their associated representative were then invited to present their submissions to the Panel.

Members of the Taxi Licensing Panel then retired to consider the application.

RESOLVED:

To take no action in relation to the applicant’s current Hackney Carriage and Private Hire Dual Drivers’ Licence. Officers are required to refer any future breach of the Taxi Policy or law which is alleged to have been committed by the applicant which may occur within 12 months of this decision to the Licensing Sub-Committee.
