APPROVED subject to the following conditions:-

 

 

 

1       No development shall take place without the prior written approval of the Local Planning Authority of all details of the following reserved matters -

         

          (a) appearance;

          (b) landscaping;

          (c) scale.

         

          Thereafter the development shall not be carried out otherwise than in strict accordance with the approved details.

 

2       Application for the approval of the reserved matters shall be made to the Local Planning Authority not later than two years from the date of this permission.  The development hereby permitted shall be begun on or before the expiration of one year from the final approval of reserved matters or in the case of approval on different dates, the final approval of the last such matter to be approved.

 

3       The development hereby permitted shall not be carried out otherwise than in strict accordance with the submitted details:

4       Notwithstanding the submitted details, amended plans of the proposed access drive west of Plot 3 clearly showing the vehicle manoeuvring and passing for the users of Plots 1 and 2 shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. The approved details shall be implemented prior to the first occupation of the development hereby permitted and retained thereafter for the lifetime of the development.

 

5       No part of the development must be brought into use until the access, parking, manoeuvring and turning areas for all users have been constructed in accordance with the details approved in writing by the Local Planning Authority. Once created these areas must be maintained clear of any obstruction and retained for their intended purpose at all times.

 

6       No development for any phase of the development must commence until a Construction Management Plan for that phase has been submitted to and approved in writing by the Local Planning Authority. Construction of the permitted development must be undertaken in accordance with the approved Construction Management Plan.

         

          The Plan must include, but not be limited, to arrangements for the following in respect of each phase of the works:

         

          3. wheel and chassis underside washing facilities on site to ensure that mud and debris is not spread onto the adjacent public highway;

          4. the parking of contractors' site operatives and visitor's vehicles;

          5. areas for storage of plant and materials used in constructing the development clear of the highway;

Variation of Condition No. 8 of planning permission 17/05491/REMMAJ to allow the boundary fence to Network Rail land to be installed prior to the occupation of the 51st dwelling, and not prior to first occupation.

REFUSED.  Reason(s) for refusal:-

 

 

1       The proposed variation of Condition 8 of planning permission Ref 17/05491/REMMAJ would compromise the operational safety of the railway infrastructure and users of the level crossing. As such it would present a serious threat to public safety contrary to Local Plan Policy HP4 and advice in the NPPF.

 

Darren Lord (Objector) attended the meeting and spoke to the item under the Council’s Opportunity to Speak Scheme.

 

The officer’s recommendations that the application be ‘deferred and approved subject to conditions and a Deed of Variation to the existing s106 Agreement’ did not receive a proposer, therefore the motion to approve fell. Councillor Hannah Gostlow proposed a motion, which was seconded by Councillor Sue Lumby that on the grounds listed above, the application be refused. On a vote being taken eleven members voted for the motion and one voted against, therefore the motion to refuse was passed.
