Apologies for absence had been received from Councillor Andrew Paraskos. Notification had been received that Councillor Tom Watson was to act as substitute for Councillor Pat Marsh and Councillor Victoria Oldham was to act as substitute for Councillor Zoe Metcalfe.

3       No Plant or materials shall be brought on site until:


          (i) A tree protection plan and specification has been submitted to and approved in writing by the Local Planning Authority demonstrating the provision of root protection fencing in line with the requirements of British Standard 5837:2012 'Trees in Relation to Construction - Recommendations' or any subsequent amendment to that document around all trees, hedges, shrubs or other planting to be retained.

          (ii) The root protection area fencing has been installed in accordance with the approved plan and specification.


          Thereafter, development shall be carried out in accordance with the approved details and the fencing shall be retained until development subject to this consent is complete. There shall be no excavation or other alteration of ground levels, storage of materials or plant, parking of vehicles, deposition of soil or rubble, lighting of fires or disposal of liquids within the area fenced off as part of the tree protection plan and specification.


4       Any major works to mature trees must be preceded by further bat assessment (either emergence survey or climbing inspection) and the survey resulted submitted and approved by the Local Planning Authority prior to the start of such works.

Demolition of 1 dwelling and erection of 37 dwellings.


APPLICANT:             S Harrison Developments Ltd


REFUSED.  Reason(s) for refusal:-



1       The proposed development would cause significant and adverse harm to the landscape, in particular in views of the site from the Ripon Rowell Walk along the Ripon Canal towpath and Ripon racecourse beyond, having regard to the elevated position of the application site in relation to these sites.  The proposed development would further harm the tranquil rural setting of the Ripon Canal. The proposed development would therefore be contrary to Core Strategy Policy SG4 and Saved Local Plan Policies HD20 and C2. The proposed development would further harm the amenity of the public footpath along the Ripon Canal towpath, contrary to Saved Local Plan Policy R11 and Ripon Neighbourhood Plan Policy G2, which seek to protect the recreational and amenity value of public rights of way.


          It is considered that the adverse impacts of the proposed development would significantly and demonstrably outweigh the benefits of the development. As the Council can demonstrate a 5 year housing land supply, the tilted balance in favour of development is not engaged in accordance with Paragraph 11 of the NPPF.



Councillor Sid Hawke declared an interest in the item and therefore he left the room for the debate and the vote.

Mike Blowman and Chris Rainer (Objectors) and Kate Broadbank (Agent) attended the meeting and spoke to the item under the Council’s Opportunity to Speak Scheme.


The officer recommendations that the application be ‘deferred and approved subject to the receipt of a Ground Stability Report and subject to conditions and a S106 agreement’ were moved and seconded. On a vote being taken three Members voted for the officer recommendations and seven against therefore the motion to defer and approve fell. It was subsequently moved and seconded that the application be ‘refused’ for the reasons as described above. On a vote being taken eight Members voted for the motion to refuse the application and two against therefore the application was refused.

determination or in consultation with either the Chair or the Solicitor to

the Council.


The Executive Officer – Development Management and Building Control submitted a list of planning applications determined under delegated powers, and also those delegated to himself in consultation with the Chair and Vice Chair of the Committee, which had been approved since the last meeting.
