Councillor Phil Ireland (Ward Member for Knaresborough Calcutt and Aspin), Steve Benn (Objector) and Robert Gaskell (Agent) attended the meeting and spoke to the item under the Council’s Opportunity to Speak Scheme.

 

The officer’s recommendations that the application be ‘deferred and approved subject to the receipt of a S106 Agreement to secure the C2 Use and the Biodiversity Enhancement Management Plan’ were moved and seconded. On a vote being taken four Members voted for the motion and seven voted against therefore the motion fell.

 

It was subsequently moved and seconded that the application be deferred for further discussions on highways matters, in particular improvements to footpaths and an improved pedestrian link, clarification on the number of parking spaces and where any visitors may park if the car park is full, flooding and further consideration of issues raised by CCG regarding requirements for health contributions. 1      The development hereby permitted shall be begun on or before 08.03.2025.

 

2      The works hereby permitted shall not be carried out otherwise than in strict accordance with the following drawings;

3      Prior to the commencement of the development hereby approved, details of a landscaping scheme shall be submitted to and agreed in writing by the Local Planning Authority. The landscaping scheme shall include but not be limited to; the number, species, size, and method of planting. Thereafter, the development shall be constructed in accordance with the approved plans.

 

4      A professional quality bat box must be provided at height either on one of the gables of the converted buildings, or one of the other buildings on site, away from any direct sources of light. The bat box must be emplaced prior to the first use of the converted building.

 

5      Removal of woody vegetation must be undertaken outside of the main birds' nesting season (March-August inclusively) unless a pre-commencement check by a suitably experienced ecologist or trained arborist determines that no actively nesting birds are present, which would be disturbed by such works.

 

 

 

Reasons for Conditions:-

 

1      To ensure compliance with Sections 91-94 of the Town and Country Planning Act 1990.

2      The development hereby permitted shall not be carried out otherwise than in strict accordance with the submitted details.

3      In the interests of visual amenity and to safeguard residential amenity.

4      To provide enhancement for biodiversity in accordance with NPPF paragraph 180(d)

5      To minimise the risk of harm to nesting birds during the course of works

 

INFORMATIVES

 

1      Mitigation measures should be included in the buildings to be used as part of the development and include:

        o  A concrete floor.

        o  Gas proof membrane beneath the floor.

        o  Sealing/protection of any services to the building.

        o  Adequate ventilation

       

        The Cremator does not require permitting by the local planning authority as it is below 50KGM/HR, however it will need to be licensed by DEFRA's Animal Health Veterinary Laboratory Authority (AHVLA) for pet cremations.

2      Removal of the ceiling or of any soffit boards must be undertaken with care. In the event of the discovery of bats or signs of bats during the course of works, works must cease until professional ecological advice has been sought on how works may lawfully proceed.

The officer’s recommendations that the application be ‘approved’ were moved and seconded. During the debate on this item Councillor Robert Windass withdrew his proposal of the motion, as did the seconder of the motion. The motion to approve therefore fell.

 

It was subsequently moved and seconded that the application be deferred for further discussion on an alternative EV charge point. On a vote being taken, Members voted unanimously for the motion therefore the motion to defer was passed.
