3      Except for investigative works, no excavation or other groundworks or the depositing of material on site in connection with the construction of any road or any structure or apparatus which will lie beneath the road must take place on any phase of the road construction works, until full detailed engineering drawings of all aspects of roads and sewers for that phase, including any structures which affect or form part of the highway network, and a programme for delivery of such works have been submitted to and approved in writing by the Local Planning Authority.         B) The condition should not be signed off until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results, archive deposition and re-burial has been secured.

 

5      Works must be undertaken in accordance with a precautionary method statement which is designed to ensure that the currently low risk of harm to bats during the course of works, is reduced to a negligible risk. 

       

        The Method Statement must be based on the following precautionary measures and its implementation must be overseen at a strategic level by a suitably qualified ecological clerk of works.

        Works to the wall should be undertaken outside the winter months, i.e. after mid-March and before the start of November.

        A tool-box talk must be given by a suitably qualified ecologist to contractors, to make them aware of the unlikely possibility of the presence of bats, prior to the start of works on site.

        Potentially suitable crevices must be marked off left undisturbed, except for pointing, where a suitable opening is left for bat access.

        Emplacement of pattress plates should be undertaken before May, unless a bat emergence or re-entry survey confirms that no bats are present.

 

Reasons for Conditions:-

 

1      To ensure compliance with Sections 91-94 of the Town and Country Planning Act 1990.

2      For the avoidance of doubt and in the interests of proper planning.

3      In the interests of visual amenity.

4      The secure archaeological monitoring.

5      To minimise the risk of harm to bats during the course of works

 

Parish Councillor Peter Saxon (Kirkby Malzeard, Laverton and Dallowgill Parish Council) and Jonathan Dunk (Applicant) attended the meeting and spoke to the item under the Council’s Opportunity to Speak Scheme.

 

The officer’s recommendations that the application be ‘deferred and approved subject to conditions’ were moved and seconded.
