(Nine Members voted for the motion and there was one abstention.)

 

Due to a delay in finalising the conditions related to the 21/04241/FUL application, the Minutes of the meeting of the Committee held on 6 January 2021 were to be considered at the following meeting of the Committee.

PROPOSAL:

Variation of condition 6 (pedestrian and cycle access) and condition 18 (construction of initial site access) of Planning Permission 19/02262/OUTMAJ (appeal reference APP/E2734/W/20/3260624) - Outline application for residential development, public open space, green infrastructure and associated works, with all matters reserved (149 dwellings indicated).

 

APPLICANT:             Mr Michael Ashworth

 

APPROVED subject to the following conditions:-

 

 

1       Details of the access, appearance, landscaping, layout, and scale, (hereinafter called "the reserved matters") shall be submitted to and approved in writing by the local planning authority before any development takes place and the development shall be carried out as approved.

 

2       Application for approval of the reserved matters shall be made to the local planning authority not later than 9 March 2024.

 

3       The development hereby permitted shall take place not later than 2 years from the date of approval of the last of the reserved matters to be approved.

 

4       Further to condition 1 above the design of the dwellings shall accord with the details set out in the Development Specific Sustainability Improvements document received by the Local Planning Authority on 6 July 2020 and a detailed Energy Statement demonstrating how the energy hierarchy has been applied to make the fullest contribution to reducing greenhouse gas emissions shall be submitted as part of the first application for approval of reserved matters.

 

5       Any application for the reserved matter of access shall accord with the points of pedestrian and vehicular access with: (a) Kingsley Road as shown on Fore Consulting Limited drawing 3368B-200-P-08 as received by the Local Planning Authority on 20 December 2019 and the double height kerbing and gateway feature as shown on Richborough Estates drawing Access/AAD001 as received by the Local Planning Authority on 2 March 2020, and (b) the boundary of the adjacent development (Housing Site H48) between points A and B as shown on the Proposed Access and Movement Plan 30164_12C received by the Local Planning Authority on 15.05.2020.

 

6       Further to condition 5 above and Plan 30164_12C any application for the reserved matter of access shall also accord with the points of pedestrian and/or cycle access with: (a) the boundaries with the adjacent developments (Housing Sites H47 and H21) between points C and D, and E and F, respectively, and (b) the boundary with the Kingsley Drive - Avondale Road cycleway at point G.

 

7       Further to conditions 5 and 6 above any application for the reserved matter of access shall include a phasing plan for the provision of these accesses.

 

8       Any application for the reserved matter of appearance shall include details of any small-scale renewable and low carbon energy generation that is to be incorporated into their design.

DEFERRED and to be approved subject to the Variation of the S106 Agreement.

 

Paul Thornton (Applicant) attended the meeting and spoke to the item under the Council’s Opportunity to Speak Scheme.

 

The officer’s recommendations that the application be ‘deferred and approved subject to variation of the S106 Agreement’ were moved and seconded. On a vote being taken seven Members voted for the motion and there were three abstentions, therefore the motion was passed.
