Councillor John Mann subsequently proposed a motion, on the grounds listed above, to defer the application. The motion was moved and seconded. On a vote being taken members voted unanimously therefore the motion to defer was passed

1       The layout, quantum of development, density and design creates a scheme that is of poor quality and is not considered to create a safe and accessible environment. The resulting layout is not considered to reflect the edge of settlement location or the principles of good layout design. Little opportunity is provided for tree lined streets contrary to paragraph 131 of the NPPF. In addition, recreational routes across the site and the location of the children's play area are not considered to be satisfactory. The application is therefore contrary to Local Plan Policies HP3, HP4, HP5 and HP7 of the Local Plan and paragraphs 92 and 130 of the NPPF.

2       The proposed layout has inadequate access provision leading to potential road safety issues and has a lack of well connected, safe pedestrian and cycle routes contrary to Local Plan Policies TI1 and TI4.

3       The proposed affordable housing does not meet the tenure and design requirements of Local Policy HS2.

3       Except for investigative works, no excavation or other groundworks or the depositing of material on site in connection with the construction of any road or any structure or apparatus which will lie beneath the road must take place on any phase of the road construction works, until full detailed engineering drawings of all aspects of roads and sewers for that phase, including any structures which affect or form part of the highway network, and a programme for delivery of such works have been submitted to and approved in writing by the Local Planning Authority. REFUSED.  Reason(s) for refusal:-

 

 

1       The proposed development would by reason of its scale and layout through the use of high density pockets of development with inappropriate layout of tenures result in overdevelopment of the site, which would be compounded by the lack of full compliance with the nationally Described Space Standards and the lack of secure cycle storage while being dominated by private vehicular parking spaces and parking courts. The resultant scheme would not represent good design as advocated within the National Planning Policy Framework and National Design Guide and hence would be contrary to the provisions of the Harrogate District Local Plan 2014-2035 Policies HP3 (Local Distinctiveness), HP4 (Protecting Amenity), HS2 (Affordable Housing), HS5 (Space Standards) and NE5 (Blue and Green Infrastructure).

2       Inadequate information has been submitted to demonstrate that the proposal can be satisfactorily drained of surface water without giving rise to otherwise avoidable flooding contrary to the provisions of the Harrogate District Local Plan 2014-2035 Policy CC1 (Flood Risk and Sustainable Development).

3       Inadequate information has been submitted to demonstrate that the proposal would not be unduly affected by noise and would not adversely impact on the local highway network or the Air Quality Management Area at Woodlands Junction, contrary to the provisions of the Harrogate District Local Plan 2014-2035 Policies HP4 (Protecting Amenity), NE1 (Air Quality) and TI1 (Sustainable Transport).

4       No documentation has been submitted to demonstrate an appropriate energy statement and a number of properties fail to  include passive design measures that would reduce the need for artificial lighting, cooling and ventilation systems contrary to the provisions of Harrogate District Local Plan 2014-2035 Local Plan Policy CC4 (Sustainable Development).

5       No documentation has been submitted to demonstrate an appropriate biodiversity enhancements plan nor an Arboricultural Impact Assessment contrary to the objectives of Harrogate District Local Plan 2014-2035 Local Plan Policies NE3 (Protecting the Natural Environment) and NE7 (Trees and Woodlands).

 

Councillor Nigel Middlemass (Ward Member for Harrogate Kingsley), Chris Watt (Objector) and Paul Butler (Agent) attended the meeting and spoke to the item under the Council’s Opportunity to Speak Scheme.
