REFUSED.  Reason(s) for refusal:-

 

 

1        The proposed development would by reason of its scale and layout through the use of high density pockets of development result in overdevelopment of the site, which compounded by the lack of secure cycle storage is dominated by private vehicular parking spaces and parking courts. The resultant scheme would not represent good design as advocated within the National Planning Policy Framework and National Design Guide and hence would be contrary to the provisions of the Harrogate District Local Plan 2014-2035 Policies HP3 (Local Distinctiveness), HP4 (Protecting Amenity).

 

Councillor Robert Windass declared an interest in the item as he was to speak as Ward Member under the Opportunity to Speak Scheme; he therefore left the room for the debate and the vote.

 

Councillor Robert Windass (Ward Member for Boroughbridge), Parish Councillor John Goss (Boroughbridge Town Council), Duncan Hall (Objector) and Liam Tate (Agent) attended the meeting and spoke to the item under the Council’s Opportunity to Speak Scheme.

 

The officer’s recommendations that the application be ‘deferred and approved subject to conditions and a S106 Agreement and upon Yorkshire Water confirming acceptance of the revised Scheme’ did not receive a proposer, therefore the motion to defer and approve fell. Councillor Nigel Simms subsequently proposed a motion, on the grounds listed above, to refuse the application. The motion was moved and seconded. On a vote being taken seven members voted for and one voted against therefore the motion to refuse was passed.

1      The development to which this approval of reserved matters relates shall be begun on or before the expiration of two years from the final approval of reserved matters or in the case of approval on different dates, the final approval of the last such matter to be approved.

1      The application site is not considered previously developed land. The proposal is therefore inappropriate development which, by definition, is harmful to the Green Belt and it would also result in some limited harm to the openness of the Green Belt. Although the proposal would bring economic benefits it is not considered that 'very special circumstances' exist that clearly outweigh the potential harm to the Green Belt by reason of inappropriateness and the impacts on openness. The proposal is contrary to national policy in the National Planning Policy Framework and Policy GS4 of the Local Plan.

Councillor John Mann (Ward Member for Harrogate Pannal), Rene Dziabas (present to read out a statement on behalf of Pannal and Burn Bridge Parish Council), David Siddans (Objector), Nick Viles (Supporter of the S106) and Harvey Emms (Applicant) attended the meeting and spoke to the item under the Council’s Opportunity to Speak Scheme.

 

The officer’s recommendations that the application be ‘deferred and approved subject to conditions and a S106 Agreement’ were moved and seconded. On a vote being taken two Members voted for, four against and there was one abstention therefore the motion to support the officer’s recommendations fell.

 

It was subsequently moved and seconded that the application be deferred until the West of Harrogate parameters plan is in place. On a vote being taken four members voted for the motion and three against therefore the motion to defer was passed.
